Terms of Service
1. Introduction
Welcome to Nadias Luxe Living. By accessing and using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.
2. Definitions
"Agreement" refers to these Terms and Conditions.
"Client" refers to the individual or entity purchasing services from Nadias Luxe Living.
"Services" refers to the styling and consultancy services provided by Nadias Luxe Living.
"Supplier" refers to Nadias Luxe Living.
3. Term of Agreement
(a) This Agreement begins on the date the Client accepts the terms and continues until the completion of the services or termination by either party as outlined in these terms.
(b) The Agreement may be extended or terminated by mutual consent in writing.
4. Provision of Services
(a) Nadias Luxe Living agrees to provide the Services as outlined in the service agreement or invoice.
(b) The Supplier will:
- Complete the Services by the agreed completion date.
- Notify the Client promptly of any potential delays.
- Provide services with the care, skill, and diligence expected of a professional in the industry.
- Use qualified personnel to deliver the Services.
5. Fees and Payment
(a) The fees for the Services are as outlined in the service agreement or invoice.
(b) Payment terms will be specified in the invoice, with payment due within 7 days of receipt unless otherwise stated on the invoice.
(c) Nadias Luxe Living reserves the right to require a deposit before commencing work.
(d) Invoices will include all relevant information required for GST purposes.
6. Cancellation and Refunds
(a) The Client may cancel the services by providing written notice to Nadias Luxe Living.
(b) If the Client cancels the services, Nadias Luxe Living may retain a portion of the fees to cover work already performed and any expenses incurred.
(c) Refunds will be issued for any services not rendered, less any applicable fees for work completed.
7. Intellectual Property
(a) All materials created by Nadias Luxe Living during the provision of the Services remain the property of Nadias Luxe Living unless otherwise agreed in writing.
(b) The Client is granted a non-exclusive, royalty-free licence to use the materials for personal use only.
(c) Any pre-existing intellectual property used during the Services remains the property of the respective owner.
8. Confidentiality and Privacy
(a) Nadias Luxe Living will maintain the confidentiality of all personal information provided by the Client.
(b) The Supplier will comply with the Australian Privacy Principles as outlined in the Privacy Act 1988.
(c) Personal information will only be used for the purpose of providing the Services and will not be disclosed to third parties without the Client’s consent, except as required by law.
9. Liability
(a) Nadias Luxe Living will take all reasonable care in providing the Services. However, the Supplier is not liable for any loss or damage arising from the use of the Services.
(b) The Client agrees to indemnify Nadias Luxe Living against any claims, damages, or expenses arising from the Client’s use of the Services.
10. Termination
(a) Nadias Luxe Living may terminate this Agreement with immediate effect if the Client breaches any terms of the Agreement.
(b) The Client may terminate the Agreement by providing written notice. In such cases, Nadias Luxe Living will retain fees for services performed and may charge for any additional costs incurred due to the termination.
11. Dispute Resolution
(a) Any disputes arising from this Agreement will be addressed through good faith negotiations between the parties.
(b) If a dispute cannot be resolved amicably, it will be referred to mediation or arbitration as agreed by both parties.
12. Governing Law
This Agreement is governed by the laws of the State of Victoria, Australia. Any legal actions or proceedings arising under this Agreement will be subject to the jurisdiction of the courts in Victoria.
13. Amendments
Nadias Luxe Living reserves the right to amend these terms and conditions at any time. The Client will be notified of any changes, and continued use of the Services constitutes acceptance of the amended terms.
